  1. If you entered without permission and were detained: If an immigration officer stops you at the border or inside the country and gives you a summons to appear in court (a "Notice to Appear"), your asylum case will be defensive.


  2. If you were denied Affirmative Asylum: This is a very common reason. If you applied for affirmative asylum with USCIS and the officer does not approve your case (and you have no other legal status), they will send your case to an immigration judge. At that point, your case becomes defensive.


  3. If your permit expired and you overstayed: For example, if you entered on a tourist visa, overstayed and then immigration finds you, they can initiate deportation proceedings. There, your only asylum option would be defensive.
