1. Humanitarian Visas.


These options are very valuable because, in most cases, it does not matter if you entered the country without permission. They focus on protecting you if you have suffered.


U Visa (If you were a victim of a crime)

If you were a victim of a serious crime in the United States (such as domestic violence, extortion, assault, kidnapping) and you assisted or are assisting the police or prosecutor in the investigation, you may qualify for a U Visa.


  • Benefit: Gives you temporary legal status and, after 3 years, opens a path to apply for permanent residency.


VAWA Petition (If you have been abused by a family member)

If your spouse, parent or child (citizen or resident) has physically or psychologically abused you, you can file a petition on your own, in secret and without the help of your abuser.


  • Benefit: If approved, you can apply for permanent residency without depending on your relative.



2. Political asylum.


If you have a real fear of returning to your country because you have been or may be persecuted, you can apply for asylum in the United States.


  • Requirements: The fear must be for one of these five reasons: your race, religion, nationality, political opinion, or because you belong to a "particular social group" (such as the LGBTQ+ community).


  • Watch your time! Generally, you must file your asylum application within one year of your arrival in the U.S. There are some exceptions, but it is a very important rule.



3. Family Petition.


Having a close family member who is a citizen or resident is one of the most common ways, but it all depends on how you entered the United States.


If you entered legally (with visa or permit)

If you entered the country legally (inspected by an officer) and are now an immediate relative of a U.S. citizen (spouse, child under 21, or parent of a citizen over 21), you can generally "adjust status" and get your Green Card without leaving the country. In these cases, Immigration will forgive an overstay.


If entered illegally (without inspection)

This is the most difficult case. Normally, you cannot fix your status within the U.S. and would have to leave for an interview at the consulate. The problem is that upon departure, a 10-year punishment for your unlawful presence is triggered. To avoid this, you would need a provisional waiver (I-601A), which requires showing that your spouse or parent (citizen or resident) would suffer "extreme hardship" without you.



4. Cancellation of Removal: A Court Defense


This option is not something you can apply for on your own. It is only a defense available if you are already in deportation proceedings before a judge.


  • Requirements (they are extremely difficult): You must test ALL of the following:


    1. Have lived in the U.S. continuously for 10 years or more.

    2. Having a "good moral character" throughout that time.

    3. Show that your deportation would cause "exceptional and extremely unusual harm" to your citizen or resident spouse, parent, or child. This is the most difficult point to prove.

1. If I entered without permission, do I have any real choice?

Yes. Humanitarian visas (U Visa and VAWA) and asylum are not based on how you entered the country.


2. How long does each process take?

Timelines vary widely. Family petitions can take months to many years, and the U Visa has a very long waiting list. Asylum can also take time. There is no single answer.


3.A friend told me that I can arrange for my citizen children, is this true?

It depends. If you entered without permission, having citizen children under 21 does not give you a direct path to residency. You could only use your children for "cancellation of removal" if you are in court and meet the extreme requirements. If you entered legally, your citizen child can apply when he/she turns 21.


4. What is the first thing I should do if I think I qualify for something?
