Supreme Court authorizes resumption of deportations of Venezuelans in the U.S.

The Supreme Court of the United States suspended a court order issued by Judge Edward Chen in San Francisco, which had blocked the deportation of approximately 350,000 Venezuelans. The decision was made by a majority of the justices, unsigned and without public explanation. Only Justice Ketanji Brown Jackson voted against it. This allows the federal government to resume deportation proceedings of Venezuelans, although it does not imply immediate deportations.

On March 31, 2025, Judge Chen ordered the Department of Homeland Security (DHS) to continue the TPS for Venezuela under the 2023 designation, in the case National TPS Alliance, et al., v. Kristi Noem et al., No. 3:25-cv-01766.


The judge argued that the conditions in Venezuela are too dangerous and that the decision to cancel TPS was based on unconstitutional animus, that is, unjustified hostility.


This judicial decision was issued despite the fact that TPS law states that TPS decisions are not subject to judicial review.

However, this decision was blocked by Judge Chen on March 31. The Department of Homeland Security (DHS) has made it clear that it fully intends to cancel the 2023 TPS as soon as it obtains a court order allowing it.
