Immigration will be able to investigate Social Networks in key proceedings.

The U.S. government has announced a new proposal that will change the way many immigration forms are filled out. If you are thinking about applying for permanent residency (green card), citizenship or asylum, it is very important that you are aware of this new rule: Immigration will be able to investigate and ask for your social media information.

This news may raise doubts, but it is nothing to be alarmed about. The purpose of this article is to explain in a simple way what this change means, what procedures it affects and what you can do to be prepared.

What does this new immigration rule mean?

Simply put, the government wants applicants to include their usernames or "identifiers" for the social networks they use (such as Facebook, Instagram, TikTok, etc.) on immigration forms.

It is important for you to know that, for now, this is a proposal. It is not yet a final rule, but it is very likely to be approved.

What procedures are affected by this new rule?

This new question will be included on some of the most important forms. If you are filing any of the following forms, this rule will affect you:

  • Form I-485: To apply for permanent residence (green card).

  • Form N-400: To apply for U.S. citizenship.

  • Form I-589: To apply for asylum.

  • Form I-751: To remove the conditions of the 2-year residency (obtained by marriage).

  • Form I-131: To apply for Advance Parole.

  • And other important forms such as the I-192, I-590, I-730, and I-829.

According to government estimates, more than 3 million people per year will have to provide this information.

Why does the government want to see my social networks?

The official reason given by the government is to reinforce national security and verify the identity of individuals. According to USCIS, reviewing public information on social networks will help them confirm that the data you put in your application is correct and that you do not represent a risk to the country.

What should I do now?

Knowing this information ahead of time gives you the advantage of being able to prepare. Here are the most important points:

1. The rule is NOT yet final.

Here's the most important thing to remember. The proposal is in a "public comment" period until October 16, 2025. During this time, people can give their input. After that date, the government will decide when the rule becomes official.

2. There will be no additional costs.

USCIS has clarified that this change will not increase the price of immigration fees. What will increase is the time it will take you to fill out the forms.

3. Check the privacy of your accounts.

This is a good time for you to review your social media privacy settings and be aware of what you post. Remember that what you share online can be seen by many people, and in the future, possibly by an immigration officer.

Frequently Asked Questions (FAQ)

1. Am I obligated to give out my social networks if they approve the rule?

Yes. If this proposal becomes a final rule, providing your social network identifiers will be a mandatory requirement on the above forms.

2. What if I don't have social networks?

If you do not use any social networks, you will most likely have to indicate this on the form. The most important thing in any immigration process is to always be honest and not hide information.

3. Can I be denied a green card or citizenship because of something I posted?

The government will use this information to verify your identity and for security reasons. Any publication that contradicts the information on your application, or shows that you pose a security risk, could cause serious problems in your case.

4. When will this rule start to apply?

There is no exact date yet. First, the public comment period must end on October 16, 2025. After that, USCIS will announce the official date when the new forms with these questions will begin to be used. We will stay tuned to let you know.
