Asylum Work Permit: Changes and news in March 2026

If you applied for asylum in the United States and are waiting for your asylum work permit, it is very likely that you have heard concerning news in recent days. President Trump's administration has introduced new measures that could change the rules for obtaining employment authorization.

We know that your work permit is vital to support your family. Therefore, in this article we will explain very simply what these proposed changes in March 2026 are, how they would affect you, and what is happening with work visas for professionals.

Important: At this time, these are proposals. We will explain what they mean so that you are well informed.

Two major proposed changes for the Asylum Work Permit

The Department of Homeland Security (DHS) has published a document with two proposals that would make it more difficult and time-consuming to get a work permit while your asylum case is pending.

1. The waiting time would increase from 180 days to 1 year

Under current laws, if you apply for asylum, you must wait 180 days (about 6 months) without the government making a decision on your case in order to be able to request a work permit.

  • ¿What is the government proposing now? They want to double that waiting time. If they approve this, asylum seekers would have to wait 365 days (a full year) before being able to submit the paperwork to request their formal work permit.

2. The risk of freezing permits for years

This is the most concerning measure. Currently, the immigration office (USCIS) is very backlogged. In 2024, almost 8 out of 10 asylum cases had been unresolved for more than six months.

  • ¿What is the government proposing? They want to freeze (suspend) the issuance of new work permits until USCIS manages to catch up and can respond to asylum cases in an average of 180 days.

  • The problem: Getting USCIS to work that fast could take many years. In practice, this would mean blocking the issuance of work permits for an indefinite time for new applicants.

H-1B Visas for professionals are also in danger

Asylum seekers are not the only ones facing possible changes. There is also news for specialized foreign workers who use the H-1B visa.

Florida Republican Representative Greg Steube proposed a bill called the "Exile Act".

  • ¿What is it about? This proposal seeks to completely eliminate the H-1B visa program.

  • ¿What would happen? If this law is approved in Congress, starting in the year 2027 there would be no more quotas for these visas, closing the door to foreign professionals seeking to work legally in U.S. companies.

¿What should you do now?

Upon reading all this, it is normal to get scared, but you must remember this: They are still proposals and bills. They still must go through legal processes and review times before becoming an official reality.

Our advice for you:

  • Do not panic: Keep attending your immigration appointments and courts.

  • Do not trust rumors: Always look for official information or consult with certified immigration attorneys. Do not be fooled by scammers who promise to fix your case quickly by charging you money.

  • Keep your papers up to date: If it is already your time to request the permit or renew it under the current rules, do it as soon as possible with the help of your attorney.

Frequently Asked Questions (FAQ)

1. ¿Is the one-year waiting rule already in effect today?

No. Up to this moment in March 2026, this is a proposal presented by the DHS. The process to change the law takes time. Until it is announced as an official final rule, the previous timeframes remain in effect. Speak with your attorney before submitting any document.

2. ¿If I already have my approved asylum work permit, are they going to take it away from me?

Proposals generally affect new applications. If you already have your valid work permit card (EAD) in your hands, it remains legal until its expiration date. However, you must be attentive to the renewal rules.

3. ¿Have the H-1B Visas already been canceled?

No. The "Exile Act" is only a bill that was just introduced. For it to become law, it must be voted on and passed by the United States Congress.
